Review of Foreign Investment Act 1999 – April 2002

At the request of the Ministry for Commerce, Business, Development and Investment a review of the Foreign Investment Act (FIA) was undertaken.

This critical appraisal included the following terms of reference:

• Review of the impact and effectiveness of the FIA on stimulating investment levels in Fiji
• Analysis of the assessment and compliance system of investment proposals at FTIB
• Benchmarking of the FIA against World Trade Organisation standards
• Determination of the effectiveness of the FIA in stimulating local shareholding and management rights within foreign joint venture companies
• Assessment of the FIA with international best practice investment legislation and formulation of recommendations where improvement was necessary

The completion of this commission included the direct communication with in excess of 150 stakeholders, critical analysis of economic data and presentation of findings to the highest of levels to withstand public and Governmental scrutiny.
